Universal lose appeal to halt MGM lawsuit over 'Section 6' movie

The legal wrangling over Universal's 'Section 6' movie, which is supposedly a period piece centered around the formation of the real life MI6 secret service in the UK, is set to continue.

Federal judge James Otero denied a motion by Universal to dismiss the copyright infringement claim from MGM and Bond owners Danjaq in a sealed motioned dated September 23rd.

MGM and Danjaq originally complained that the 'Section 6' movie was "in active development, featuring a daring, tuxedo-clad British secret agent, employed by ‘His Majesty’s Secret Service,’ with a ‘license to kill,’ and a 00 secret agent number on a mission to save England from the diabolical plot of a megalomaniacal villain.... Most moviegoers would assume from that description alone that this lawsuit concerns the next James Bond picture. It does not."

Universal tried to claim that the movie hasn't been 'green lit' yet, so the claim wasn't relevant.

But perhaps Universal shouldn't have hired a director (Joe Cornish), and even cast the leading role, if they wanted to convince the judge that the project was still in the conceptual stage. It probably didn't help their claim when English actor Jack O’Connell told the UK press last week that he had secured the role and filming was planned.

MGM and Danjaq's complaint will now be heard in court as the suit has been given the go ahead to proceed.
